EXTENDED MANUFACTURER'S RESPONSIBILITY (RZV)
WHAT IS RZV:
Summary of manufacturer’s obligations of the reserved product, relating to the product during all phases of its life cycle, whose aim is to prevent the generation of waste from the reserved product and to strengthen the reuse, recycling or other recovery of this waste.
They are mainly requirements to ensure the material composition or construction of the reserved product, information about its composition and the management of the reserved waste stream, to ensure the management of the reserved waste stream and to ensure the financial coverage of the mentioned activities).
(This applies to producers of a reserved product. A producer of a reserved product is a natural person, entrepreneur or legal entity that markets the product in the Slovak Republic.)

INTRODUCING THE RESERVED PRODUCT ON THE MARKET OF THE SR

GENERAL OBLIGATIONS OF THE MANUFACTURER OF THE RESERVED PRODUCT (§ 27 par. 4, 5)
Registration in the Register of exclusive product manufacturers + notification of changes registered data
Ensure in accordance with a specific section of the law (reference to Act No. 529/2010 Coll. on Ecodesign.
– material composition of the product
– its construction
– its marking
Ensure recovery and recycling of the exclusive waste stream at least in the amount of binding goals and limits of recovery and recycling for the reserved waste stream established in Annex no. 3 of the Act.
Keep and keep records and reports data from them to the ministry within the established scope and keep reported data.
Calculate your collection share and market share in accordance with a specific section of the law, based on data published by the Ministry on its website,
From July 1, 2019, also ensure the fulfillment of goals collection established in Annex no. 3a of the Act:
from 1.7.2019 to 30.6.2020 40%
from 1.7.2020 to 20.6.2021 50%
from 1.7.2021 to 20.6.2022 60%
Ensure removal of the entire amount of separately collected municipal waste component belonging to the dedicated waste stream at the municipality in which it is responsible for the dedicated waste stream
Bears all financial costs associated with the collection, transportation, preparation for re-use, valuation, recycling, processing and disposal of separately collected goods belonging to the designated waste stream, except if these obligations are fulfilled by the distributor.
To fulfill the information obligation in relation to end users of the reserved product in accordance with a specific section of the law and in the established manner.
Ensure management of the dedicated waste stream to the extent and in the manner specified in the special section of the law.
To appoint an authorized representative in the case of a foreign manufacturer.
RESPONSIBILITY FOR BREACH OF OBLIGATIONS § 117 ADMINISTRATIVE OFFENSES
A fine will be imposed by the competent body of the state administration of waste management on a legal entity or a natural person – an entrepreneur who violates the obligations established by this law.
